WTO’s Valuation Agreement (Link included)

Mr. Noorca M. Massardi posted the (original Indonesian language) previous post on twitter. I was intrigued by this fact, so I browse around the WTO’s documents to try and find the aforementioned Valuation Agreement. After reading and browsing for quite a while, I finally found it. Heck yeah, I found it! The link of the whole Agreement on Implementation of Article VII of the General Agreement on Tariffs and Trade 1994 (Customs Valuation Agreement) can be found here :

As for the complete Article 8, Paragraph 1 (c) that was mentioned on the previous post are as follows:

Paragraph 1(c)

1.     The royalties and licence fees referred to in paragraph 1(c) of Article 8 may include, among other things, payments in respect to patents, trade marks and copyrights. However, the charges for the right to reproduce the imported goods in the country of importation shall not be added to the price actually paid or payable for the imported goods in determining the customs value.

2.     Payments made by the buyer for the right to distribute or resell the imported goods shall not be added to the price actually paid or payable for the imported goods if such payments are not a condition of the sale for export to the country of importation of the imported goods.

It’s official! Thank you Mr. Darussalam, thank you Mr. Noorca. I really hope this Valuation Agreement can end this polemic once and for all.
